The 2016 Revised Implementing Rules and Regulations (IRR) of Republic Act No. 9184, otherwise known as the Government Procurement Reform Act

“The provisions of this IRR are in line with the commitment of the Government of the Philippines (GoP) to promote good governance and its effort to adhere to the principles of transparency, accountability, equity, efficiency, and economy in its procurement process. It is the policy of the GoP that procurement of Goods, Infrastructure Projects and Consulting Services shall be competitive and transparent, and therefore shall undergo competitive bidding, except as provided in Rule XVI of this IRR.”

The UP System Bids and Awards Committee (BAC)

In accordance with the Rule V Section 11 of Republic Act 9184, each Procuring Entity shall establish in its head office a single BAC to undertake the functions specified in Section 12 of the IRR in order to facilitate professionalization and harmonization of procedures and standards. In line with the standardization of procurement procedures and the thrust towards strengthening the procurement function to increase operational efficiency and effectiveness, Heads of Procuring Entities shall aim to consolidate or unify all procurement activities of the organization, whether locally-funded or foreign assisted, and whether pertaining to Goods, Infrastructure Projects or Consulting Services.

Currently, the UP System BAC is composed of  the following five (5) regular members:

Functions and Responsibilities of the BAC

According to the Section 12 of the IRR of RA 9184, the following are the functions of the BAC:

  1. advertise and/or post the invitation to bid/request for expressions of interest;
  2. conduct pre-procurement and pre-bid conferences;
  3. determine the eligibility of prospective bidders;
  4. receive and open bids;
  5. conduct the evaluation of bids;
  6. undertake post-qualification proceedings;
  7. resolve requests for reconsideration;
  8. recommend award of contracts to the HoPE or his duly authorized representative:
  9. recommend the imposition of sanctions in accordance with Rule XXIII;
  10. recommend to the HoPE the use of Alternative Methods of Procurement as provided in Rule XVI of the act and its IRR;
  11. conduct any of the Alternative Methods of Procurement;
  12. conduct periodic assessment of the procurement processes and procedures to streamline procurement activities pursuant to Section 3(c) of this IRR;
  13. perform such other related functions as may be necessary, including the creation of a Technical Working Group (TWG) from a pool of technical, financial, and/or legal experts.

The BAC Secretariat

The BAC Secretariat serves as the main support unit of the Committee. Currently, the UP System BAC Secretariat is designated to the System Supply and Property Management Office (SPMO). Prof. Bagus, the current Chief of the System SPMO, serves as the Head BAC Secretary.

The BAC Secretariat have the following functions and responsibilities

  1. Provide administrative support to the BAC and the TWG;
  2. Organize and make all necessary arrangements for BAC and the TWG meetings and conferences;
  3. Prepare minutes of meetings and resolutions of the BAC;
  4. Take custody of procurement documents and other records and ensure that all procurements undertaken by the Procuring Entity are properly documented;
  5. Manage the sale and distribution of Bidding Documents to interested bidders;
  6. Advertise and/or post bidding opportunities, including Bidding Documents
  7. Assist in managing the procurement processes;
  8. Monitor procurement activities and milestones for proper reporting to relevant agencies when required;
  9. Consolidate PPMPs from various units of the Procuring Entity to make them available for review as indicated in Section 7 of this IRR and prepare the APP; and notices of awards;
  10. Act as the central channel of communications for the BAC with end-user or implementing units, PMOs, other units of the line agency, other government agencies, providers of goods, infrastructure projects, and consulting services,observers, and the general public.

Technical Working Group

The Technical Working Group (TWG ) are representatives from a pool of technical, financial, and/or legal experts constituted by the BAC to assists in the following:

  1. Review of the Technical Specifications, Scope of Works, and Terms of Reference
  2. Review of Bidding Documents
  3. Shortlisting of Consultants
  4. Eligibility Screening
  5. Evaluation of Bids
  6. Post-Qualification including site inspection;
  7. Resolution of Request for Reconsideration.
